Please read these Terms of Service ("Terms") carefully before using the FriendsMap mobile application and website operated by FriendsMap ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the Service.
By creating an account or using FriendsMap, you confirm that you are at least 13 years of age (or have parental consent if between 13–17), and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
FriendsMap is a mobile application that allows users to share their real-time location with friends, create and participate in events, use augmented reality features, coordinate group navigation, and communicate via in-app chat. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.
You must create an account to use most features of FriendsMap. You agree to:
Accounts are for individual, personal use. You may not create accounts on behalf of others without their knowledge and consent.
Your use of FriendsMap is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of location data as described in the Privacy Policy. You are solely responsible for managing who you share your location with. We are not liable for any harm arising from your choice to share your location with other users.
You agree not to use FriendsMap to:
You retain ownership of content you create through FriendsMap (messages, AR tags, profile information). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely for the purpose of operating the Service. We do not claim ownership of your content.
You are solely responsible for the content you post. We reserve the right to remove content that violates these Terms or is otherwise objectionable.
AR tags you create are anchored to real-world geographic locations. You agree not to place AR tags on private property without permission, near sensitive facilities (schools, hospitals, government buildings), or containing offensive, harmful, or illegal content. We may remove AR tags at our discretion.
FriendsMap provides tools for creating events and issuing tickets. Event organizers are solely responsible for the events they create, including compliance with local regulations, venue permits, safety, and any obligations to ticket holders. FriendsMap is not a party to any agreement between event organizers and attendees.
Enterprise accounts using ticketing features agree to additional terms provided at the time of enterprise account setup.
The FriendsMap name, logo, app design, and software are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its software, nor may you reverse engineer or attempt to extract the source code.
FriendsMap integrates third-party services including HERE Maps and Firebase. Your use of these services through our app is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Location accuracy depends on device hardware and network conditions and may not always be precise.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $50 CAD OR THE AMOUNT YOU PAID US IN THE SIX MONTHS PRECEDING THE CLAIM.
FriendsMap includes safety features such as SOS contacts. These features are provided as a convenience and are not a substitute for emergency services. In an emergency, always contact 911 or your local emergency number. We are not liable for any failure of safety features.
You agree to indemnify and hold harmless FriendsMap and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the app settings.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date and, for material changes, by in-app notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FriendsMap regarding the Service and supersede any prior agreements.
